Terms of Service

Eligibility. You must be at least 18 years old and able to form a binding contract to use the Service.

Account security. You are responsible for keeping your credentials secure. Notify us immediately at contact us if you suspect unauthorized access.

5-year account term. Accounts are active for five years from the date of your first purchase. We will email you a reminder before your account expires. On expiry, we will give you 30 days to export your data before your account is closed and all associated data is permanently deleted.

aftyr provides five tools under a single account and dashboard:

All tools are available from day one. You may use any combination up to the number included in your purchase.

Single site / application. The Service is intended for use on a single website or application per account. Using a single account across multiple unrelated sites or on behalf of third-party clients is not permitted. A separate account is required for each additional site or client.

One-time purchase. You pay once and receive a lifetime usage bucket — there is no recurring subscription. Your payment is processed by Stripe.

Usage buckets. Each tool is bounded by a usage bucket:

When a bucket runs out. The relevant tool pauses. You may top up your bucket at any time to resume. We will notify you when you reach 80% of your bucket.

All purchases are final. We do not offer refunds.

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You must not:

• Use the Service to violate any applicable law or regulation.
• Use Pulse to monitor any website, service, or endpoint that you do not own or have explicit permission to monitor. Violation is grounds for immediate account suspension.
• Use Replay to record sessions on pages you do not operate or control.
• Use Chat or Desk to harass, spam, or deceive end-users.
• Attempt to reverse-engineer, decompile, or extract the underlying source code of the Service.
• Resell or sublicense access to the Service.
• Use the Service to transmit malware or engage in any activity that could damage or impair the Service.

You own your data. All recordings, transcripts, tickets, and survey responses you generate through the Service belong to you.

License to operate. You grant us a limited license to store and process your data solely to provide the Service to you.

You may delete your data at any time. You can delete any stored content — transcripts, tickets, responses, recordings — directly from the dashboard at any time.

Data export. You can export your data at any time. We actively recommend moving to best-of-breed tools when you outgrow us and provide export formats to make that straightforward.

Automatic deletion. Session recordings captured through Replay are deleted on a 30-day rolling basis; older recordings are removed automatically. Pulse error data is retained for 7 days. You are responsible for exporting data you want to keep before these windows close.

End-user data (Replay, Chat, Voice). These tools capture data about your end-users. You are responsible for:

• Having a lawful basis (e.g. a privacy policy and appropriate disclosures) to collect your end-users' data.
• Ensuring your use of these tools complies with applicable privacy laws (GDPR, CCPA, etc.) in your jurisdiction.

Replay — PII masking. aftyr automatically masks known sensitive fields such as passwords and common PII fields in session recordings. You are responsible for identifying and marking any additional sensitive fields in your Replay implementation so that they are not captured. We are not liable for data captured because you did not configure masking for fields specific to your application.

We act as a data processor for your end-user data. Our processing obligations are set out in our Privacy Policy.

Because Pulse actively sends requests to external endpoints:

• You may only monitor services you own or are expressly authorized to monitor.
• If a monitored endpoint is unreachable for 30 consecutive days, monitoring for that endpoint is automatically suspended. You can re-activate it manually.
• You must not configure Pulse to perform checks at a rate that constitutes a load test or denial-of-service against any endpoint.

Violation of these rules may result in immediate suspension of Pulse access or your entire account.

Support is provided on a reasonable-efforts basis — contact us to reach us. We are a small team and response times are not guaranteed.

The aftyr name, logo, and platform code are our property. These Terms do not grant you any rights to our intellectual property beyond what is necessary to use the Service.

By you. You may close your account at any time. Closing your account does not entitle you to a refund of any unused bucket.

By us. We may suspend or terminate your account immediately if you violate these Terms, particularly Section 4 (Acceptable Use) or Section 6 (Pulse monitoring rules). For less serious violations we will give notice and an opportunity to remedy before terminating.

Effect of termination. On termination or expiry, your access to the Service ends and your data is scheduled for permanent deletion.

We may update these Terms from time to time. If we make material changes, we will email you at least 30 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms. If you do not agree, you may close your account before the changes take effect.

These Terms are governed by the laws of the United States.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration on an individual basis. You and aftyr each waive the right to participate in a class action or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and aftyr regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full force.
